In constitutional scholarship, legal sanctions and customary law seem to be opposed to each other: customary law is often defined precisely as law without sanctions. Applied to the constitutional field, it is possible to better define those two elements of discourse: constitutional sanctions are essentially procedures of constitutional review of legislation, while customary law is more frequently referred to as constitutional conventions. While insisting on the presence of the element of sanction is typical of the normative discourse attributed to Hans (...) Kelsen, stressing the importance of constitutional conventions implies different strategic goals. This paper is about paradigmatic slurs, i.e. expressions that are prima facie associated with the expression of a contemptuous attitude concerning a group of people identified in terms of its origin or descent, race, sexual orientation, ethnia or religion, gender, etc. Our purpose is twofold: explaining their expressive meaning dimension in terms of a version of stereotype semantics and analysing their original and most typical uses as insults, which will be called with a neologism ‘insultive’, in terms of a speech (...) act theory. What should citizens understand about science to participate in democratic life? Against the prevailing approach, we argue that “what” a public understanding of science is about strongly depends on the specific epistemological nature of the science related issues considered in different contexts and circumstances. We identify three specific categories of such issues and show how, equally, specific models of public understanding are required to address them. Only by endorsing such an alternative approach will citizens arguably be able to form sound (...) opinions about those very issues, as well as to discuss and deliberate rationally about them. This paper presents the collective reflection of a temporary community of inquiry (COI) created during an international workshop at the 20th biennial ICPIC conference--“Philosophy In And Beyond the Classroom: P4wc Across Cultural, Social, and Political Differences”-- and the suggestions emerging from that event. The workshop, entitled “Pedagojazz—improvising and inquiring, community interplay”, was conducted via Zoom, but participants were both online and present in person. The topic focused on the pedagojazz perspective, and the short activities proposed were aimed at involving the (...) (temporary) COI in a collective discussion about how it would be possible to transform a community of inquiry into an inquiring-jazzing community. Three premises were introduced as common background on which to develop our reflections: the pedagojazz perspective; the connection between pedagojazz idioms and the different roles of the facilitator in P4wC; and the idea that jazz, and collective improvisation in particular, can inform COI development. The principles and practices of pedagojazz and collective improvisation are presented in detail here. During the workshop, Zoom chat and the Wooclap site were used to involve all participants and to gather their contributions and suggestions. A word cloud and three tables were produced and are presented here. Interesting themes, questions and perspectives emerged that can help us reflect in a more complex way on the education of P4wC facilitators across cultural, social and political differences. The coronavirus disease 2019 pandemic has strongly affected oncology patients. Many screening and treatment programs have been postponed or canceled, and such patients also experience fear of increased risk of exposure to the virus. In many cases, locus of control, coping flexibility, and perception of a supportive environment, specifically family resilience, can allow for positive emotional outcomes for individuals managing complex health conditions like cancer. This study aims to determine if family resilience, coping flexibility, and locus of control can mitigate (...) the negative affect caused by the pandemic and enhance positive affect in breast cancer patients. One hundred and fifty-four female patients with breast cancer completed the Walsh’s Family Resilience Questionnaire, the Perceived Ability to Cope With Trauma Scale, the Positive-Negative Affect Schedule, and the Mini Locus of Control Scale. Family resilience and internality of locus of control contribute significantly to positive affective responses. Family resilience is responsible for mitigating the negative affect perceived during the pandemic and is enhanced by external locus of control. Evidence suggests that clinical psychologists should develop and propose programs to support oncology patients’ family resilience, coping flexibility, and internal locus of control, allowing for decreased stress and improved adaptability for effectively managing cancer treatment during the pandemic. Este artigo intenta apresentar como a pregação de Santo António de Pádua está conectada com a cidade. Através de alguns exemplos tomados das legendas hagiográficas e sermões, o autor reconstrói as mudanças de atitudes de hagiógrafos e pregadores ligados a António algumas vezes a um contexto urbano geral e, em última medida, a cidade de Pádua. Em particular, o artigo se detém sobre alguns textos que destacam o efeito da pregação de Santo António no seu público-alvo, ou seja, a população (...) da cidade em que falava. O período da análise é primariamente compreendido durante a canonização do santo, em meados do século XIV. Apesar disso, algumas referências a autores da época posterior serão feitas como comparação e aprofundamento da panorâmica oferecida. No final da Idade Média, santo António acabaria por ser, em certa medida, o modelo para os frades mendicantes, talvez atraídos pelos santos mais próximos no tempo. (shrink)

There is a sense in which pluralism needs no advocate. It is enough to take a quick look at contemporary science to realise that pluralism is common currency. It is a ‘fact’ that scientific disciplines entail a plurality of approaches, methods, styles of inquiry. It is equally easy to acknowledge how the referents of scientific investigation require a concert of disciplines and a variety of explanatory strategies. So pluralism seems to have both an epistemological and an ontological backing.1 Nor is (...) pluralism properly a new topic in philosophy of science. To some extent it is as old as its contending topic, the unity of science – that is at least as old as logical positivism, though back in those days, more than a properly well defined alternative perspective, it ranked as a critical reaction of the few against the many to the excesses of unification, and of reduction. One voice among the few was that of Patrick Suppes who, in a rather memorable PSA Presidential address in 1978, forcefully argued that neither the languages nor the subject matters of scientific disciplines were reducible to one. Recommendation systems (RSs) predict what the user likes and recommend it to them. While at the onset of RSs, the latter was designed to maximize the recommendation accuracy (i.e., accuracy was their only goal), nowadays many RSs models include diversity in recommendations (which thus is a further goal of RSs). In the computer science community, the introduction of diversity in RSs is justified mainly through economic reasons: diversity increases user satisfaction and, in niche markets, profits.I contend that, first, the economic (...) justification of diversity in RSs risks reducing it to an empirical matter of preference; second, diversity is ethically relevant as it supports two autonomy rights of the user: the right to an open present and the right to be treated as an individual. So far, diversity in RSs has been morally defended only in the case of RSs of news and scholarly content: diversity is held to have a depolarizing effect in a democratic society and the scientific community and make the users more autonomous in their news choices. I provide a justification of diversity in RSs that embraces all kinds of RSs (i.e., a holistic moral defense) and is based on a normative principle founded on the agency of the user, which I call the right to be an exception to predictions. Such a right holds that the proper treatment of a RS user qua agent forbids providing them with recommendations based only on their past or similar users’ choices. (shrink)

I develop a strategy for representing epistemic states and epistemic changes that seeks to be sensitive to the difference between voluntary and involuntary aspects of our epistemic life, as well as to the role of pragmatic factors in epistemology. The model relies on a particular understanding of the distinction between full belief and acceptance , which makes room for the idea that our reasoning on both practical and theoretical matters typically proceeds in a contextual way. Within this framework, I discuss (...) how agents can rationally shift their credal probability functions so as to consciously modify some of their contextual acceptances; the present account also allows us to represent how the very set of contexts evolves. Voluntary credal shifts, in turn, might provoke changes in the agent’s beliefs, but I show that this is actually a side effect of performing multiple adjustments in the total lot of the agent’s acceptance sets. In this way we obtain a model that preserves many pre-theoretical intuitions about what counts as adequate rationality constraints on our actual practices—and hence about what counts as an adequate, normative epistemological perspective. The paper explores the interplay among moral progress, evolution and moral realism. Although it is nearly uncontroversial to note that morality makes progress of one sort or another, it is far from uncontroversial to define what constitutes moral progress. In a minimal sense, moral progress occurs when a subsequent state of affairs is better than a preceding one. Moral realists conceive “it is better than” as something like “it more adequately reflects moral facts”; therefore, on a realist view, moral progress (...) can be associated with accumulations of moral knowledge. From an evolutionary perspective, on the contrary, since there cannot be something like moral knowledge, one might conclude there cannot even be such a thing as moral progress. More precisely, evolutionism urges us to ask whether we can acknowledge the existence of moral progress without being committed to moral realism. A promising strategy, I will argue, is to develop an account of moral progress based on moral understanding rather than moral knowledge. On this view, moral progress follows increases in moral understanding rather than accumulations of moral knowledge. Whether an understanding-based account of moral progress is feasible and what its implications for the notion itself of moral progress are, will be discussed. (shrink)

This article focuses on the animal cruelty, health, psychological and social consequences, as well as environmental consequences of an animal-based diet. Animals are intensively bred and raised in factory farms in the most inhumane ways. By far, the greatest numbers of animals reared and killed by humans every year is for human consumption. The numbers are estimated to be greater than 56 billion animals globally. The cruelty involved in the intensive farming of animals is the most widespread form of cruelty (...) imposed by humans on other species. This has significant implications for who we are as a species. Moreover, the belief that humans need to consume animal products to maintain good health has been seriously questioned over the past few decades. It is also a lifestyle choice that is responsible for significant damage to the environment. In contrast, a strong evidence base exists to show that a plant-based diet is health promoting and sustainable. Thus, by cultivating a culture of compassion toward nonhuman animals, current and future generations will benefit through better physical and psychological health and through markedly reduced damage to the planet and all of its inhabitants. In this essay, I appeal to the mental file approach in order to give an anti-realist semantic analysis of statements containing fictional names. I claim that fictive and parafictive uses of them express conceptual, though not general, propositions constituted by mental files, anchored in the conceptual world of the corresponding fictional story. Moreover, by positing a referential shift determined by the presence of a simulative referential intention characteristic of those uses, it is possible to take them to be true with (...) respect to those conceptual worlds. As for metafictive uses, since they are grounded on mixed intentions, they are considered to express hybrid propositions, partly conceptual and partly referential. (shrink)

This paper is focused on the abstractist theory of fictional discourse, namely, the semantic theory according to which fictional names refer to abstract entities. Two semantic problems that arise in relation to that position are analysed: the first is the problem of accounting for the intuitive truth of typically fictive uses of statements containing fictional names; the second is the one of explaining some problematic metafictive uses, in particular, the use of intuitively true negative existentials.Este artículo se ocupa de la (...) teoría abstracta del discurso de ficción, a saber, la teoría semántica según la cual los nombres de ficción refieren a entidades abstractas. Other-perspective taking, distancing, time discounting as well as risk and loss aversion highly affect decision-making. Even though they influence each other, so far these cognitive processes have been unrelated or only partly related to each other in neuroscience. This article proposes a philosophical interpretation of these cognitive processes that is elaborated in the updated theory of Adam Smith’s prudence. The UTSP is inspired by Smith’s account of prudence and is in line with the neuroscientific and behavioral studies on OPT, distancing, (...) time discounting as well as risk and loss aversion. The UTSP represents a framework aiming to interpret and connect these cognitive processes and providing a consistent and empirically sound account of a “Smithianly” prudent style of decision-making. The two pillars of the UTSP are the shift of perspective in space and time and loss aversion. On the basis of this theory, a normative updated theory of Smithian prudence is outlined. The latter is useful for moral philosophy for two reasons: firstly, according to preliminary evidence, it is effective in guiding the agent in decisional contexts in which her well-being is at stake and she can affect other people with her actions. Secondly, since the NUTSP is based on neuroscientific findings on decision-making, it has a sound empirical basis that prevents a source of alienation for the agent. (shrink)

This paper focuses on the treatment of prudence by Adam Smith. Smith was one of the few philosophers to conceive of it as a moral virtue. Smithian prudence is the care of one's own happiness that is limited and ennobled, respectively, by the sense of justice and that of self-command. A reconstruction of Smith's view of prudence helps to clarify three central points in his thought: the interaction between the agent's economic and moral dimensions, the relationship between the self and (...) the other, and the dialectical tension between partiality and impartiality. Furthermore, Smithian prudence is important, in itself, as an approach to the above-mentioned points that is still viable. These three points are recurrent crucial issues in the history of ethics. Firms that wish to be morally responsible in providing products that meet a high standard of safety may face problems competing against firms that make unsafe products and sell these products at cheap prices; these problems may be compounded when consumers do not accurately process information about safety and risk. This paper presents a conceptual argument that the tort system may serve to promulgate information which makes it feasible for firms to market safe products even in the face of these (...) competitive obstacles.To corroborate the conceptual argument, the paper presents the results of an experimental study about the impact of negligence liability information on consumer product safety evaluation. The results show that provision of negligence information heightens consumer concern for safety and firms' ethical behavior, and increases the proportion of consumer choices in favors of the brands sold by manufacturers with a favorable track record for quality. More importantly, they indicate that provision of negligence information reduces the likelihood that brands which conform to inferior safety standards will be chosen by consumers who care about safety standards. On June 29, 2019, Carola Rackete docked the rescue ship Sea-Watch 3 on the Sicilian island of Lampedusa, in defiance of a ban imposed by Italy's Interior Minister Matteo Salvini. The migrants rescued by the Sea-Watch 3 had been blocked at sea for the previous two weeks, making it to international headlines and sparking a heated debate around sovereignty and humanitarianism in the face of the European migration crisis. On her arrival, Rackete was arrested for refusing to obey a military (...) vessel and aiding illegal immigration.This paper investigates social media and international news discourses around the Sea-Watch 3 docking, to be regarded as a critical incident capable of catalysing attention and generating a significant media resonance. Results show how both social and traditional media contributed to the proliferation of misogynous attacks against Captain Rackete, at the intersection between right-wing populist discourses of Italian ‘sovranism’ and European anti-immigrationism. By triangulating the role of the media, intersectional hostility and populist ideology, this paper sheds light on how these three factors feed into each other in the discursive construction of the ‘Fortress Europe’ of present times. The two dominant theories relating to animal cruelty are critically reviewed. These are (1) the violence graduation hypothesis and (2) the deviance generalization hypothesis. The outcomes indicate very high consistency with the broader antisocial behavior and aggression literature, which is large and very robust. This strongly supports the validity of the animal cruelty theory proposals. Proposals that animal cruelty is one of the earliest indicators of externalizing disorders and that it is a marker of development along a more severe trajectory (...) of antisocial and aggressive behaviors are supported. Nel sesto libro del De musica Agostino pone il problema della natura del conoscere a partire da una descrizione, che si potrebbe definire fenomenologica, dei movimenti ritmici di cui il soggetto fa esperienza. Inizia così un percorso conoscitivo, che prendendo le mosse dalle tracce dei numeri arriva a indagare le condizioni di possibilità della conoscenza, rilanciando continuamente l’indagine su molteplici livelli. Con questo articolo si intende comprendere le più rilevanti implicazioni del paradigma conoscitivo agostiniano, il quale non appare riducibile a (...) una mera logica numerica ma permette di gettare uno sguardo filosofico fino alla realtà metafisica della creatura. In the De musica’s sixth Book Augustin puts the question of the knowledge’s nature from the description of the rhytmical movements experienced by the subject. This is the beginning of a cognitive process that starts from the numers’ traces and ends with the inquiry about the conditions of knowledge’s possibility, giving impulse to a research on several levels. The article’s purpose is to understand the most important implications of the Augustinian cognitive paradigm, that doesn’t seem to be a mere numerical logic but allow us to take a philosophical glance to the creature’s metaphysical truth. Research shows that animal cruelty shares many of the aetiologial pathways and risk factors that have been shown for other aggressive behaviors. The shared aetiology not only aids understanding of the co-occurrence that has been documented between animal cruelty and other aggressive and antisocial crimes, it also highlights the dangers over and above those to animals that are lurking where animal cruelty offenders remain unidentified and their crimes remain unsanctioned. This article reviews current understandings about the development of antisocial behaviors, (...) including human aggression, and animal cruelty behaviors. Available research leads one to ask, when individuals have been found to be guilty of animal cruelty, what other aggressive behaviors might they be guilty of? For young children, one must ask, are they victims of child abuse, are they living in circumstances of domestic violence, and/or what is the aggression or violence that they may have been witness to? Animal cruelty, and most aggressive behaviors from the later childhood years onward, are indicators of non-normative development. Early detection of such behaviors can provide a valuable opportunity to engage in preventative intervention for young people or for appropriate sanctions to be applied for adults. Such interventions would be beneficial for all, humans and animals alike. (shrink)

The concept of solidarity has been receiving growing attention from scholars in a wide range of disciplines. While this trend coincides with widespread unsuccessful attempts to achieve solidarity in the real world, the failure of solidarity as such remains a relatively unexplored topic. In the case of the so-called European Union refugee crisis, the fact that EU member states failed to fulfil their commitment to solidarity is now regarded as established wisdom. But as we try to come to terms with (...) failing solidarity in the EU we are faced with a number of important questions: are all instances of failing solidarity equally morally reprehensible? Are some motivations for resorting to unsolidaristic measures more valid than others? What claims have an effective countervailing force against the commitment to act in solidarity? (shrink)

In this paper, I am concerned with the possibility of applying an abductive strategy in founding ethical realism. First, I criticize Harman’s position, according to which abduction, though useful for founding scientific realism, does not serve to found ethical realism. Secondly, I examine Sturgeon’s critique, according to which distinctively moral facts do constitute the best explanations of the moral evidence. Finally,I conclude that Sturgeon is right in as far as the ontological status of moral properties is concerned but his answer (...) to Harman’s point is not properly developed. (shrink)

This paper is centered on the semantic theory of truth, formulated by Alfred Tarski. According to some authors, this theory is to be construed as a contemporary version of the traditional correspondence theory, namely, the one that defines truth as the correspondence between language and the world. In contrast, there are others who think that Tarki´s theory reveals a deflationary conception of truth, according to which truth can be reduced to a linguistic resource for semantic ascent. Since I agree with (...) the last group, I set out to support a special version ─the so-called “semanticalist version” ─ of the deflationary interpretation of the semantic theory. In the first section, I characterize the two alternative conceptions of truth above mentioned, that is, correspondence and deflationism. The second section contains and exposition of the modal argument, wich takes the Tarskian theory to inspire a syntacticalist version of the deflationary conception. In the third section, I criticize the argument in question and attempt to ground the above mentioned wide, semanticalist interpretation of deflationism. (shrink)

Satisfaction with life is a core dimension of well-being that can be of great importance in the workplace, in light of the close link between worker health and organizational success highlighted by the perspective of healthy organizations. This study aimed at analyzing the factors associated with satisfaction with life, focusing on the role of resilience, career adaptability, self-efficacy, and years of education. A sample of 315 workers filled out the Satisfaction with Life Scale, General Self-Efficacy Scale, Career Adapt-Abilities Scale, the (...) 10-item Connor-Davidson Resilience Scale, and a demographic questionnaire. Data were analyzed by implementing a chained mediation model. Results showed a significant and positive relationship between resilience and satisfaction with life, partially moderated by the chained effect of career adaptability and self-efficacy, controlling for education. When inserted as a covariate, education showed a significant and negative association with satisfaction with life. Such findings contribute to enriching the field of research on the factors that contribute to the well-being of workers and may have important practical implications for interventions in organizations.
